Amendment to Article 2 and Article 6 promulgated on June 15, 2016
Article 1
The quarantine requirements are enacted pursuant to Article 33 of the Statute for Prevention and Control of Infectious Animal Diseases.
Article 2
The following animals are prohibited from importation; exceptions apply to those imported for research purposes with prior permission granted by the central competent authority (CCA):
(1) Bats.
(2) Bovine from a country (zone) recognized by the CCA as a country (zone) with reported case(s) of bovine spongiform encephalopathy (BSE).
(3) Susceptible animals from a country (zone) recognized by the CCA as a country (zone) infected with foot and mouth disease, rinderpest, contagious bovine pleuropneumonia or African swine fever.
(4) Elephants from a country (zone) recognized by the CCA as a country (zone) infected with foot and mouth disease.
(5) Perissodactyl animals from a country (zone) recognized by the CCA as a country (zone) infected with glanders.
(6) Poultry and birds from a country (zone) recognized by the CCA as a country (zone) infected with highly pathogenic avian influenza.
(7) Susceptible animals of a designated epizootic disease from a country (zone) which has been recognized by the CCA, by the World Organization for Animal Health (OIE) or confirmed from other international information sources as a country (zone) of the said disease.
For animal species listed in subparagraphs (3) to (7) of the first paragraph originating from a country (zone) free from the disease(s) listed correspondingly, but transshipped (with change of vehicles) during transportation in an infected country (zone), shall be deemed as originating from an infected country (zone). However, this requirement does not apply to the animals subjected to appropriate risk mitigation measures which allow them to obtain prior permission granted by the CCA.
Article 3
To import the following animals, it is required to apply from the animal quarantine authority for issuance of quarantine requirements and shall be in compliance with the quarantine requirements for the animal species listed in the corresponding appendixes:
(1) Cattle, Cattle from Australia: listed in Appendix 1-1, 1-19.
(2) Pigs: listed in Appendix 1-2.
(3) Sheep and goats: listed in Appendix 1-3.
(4) Deer: listed in Appendix 1-4.
(5) Horses: listed in Appendix 1-5.
(6) Wildlife: listed in Appendix 1-6.
(7) Non-human primate wildlife: listed in Appendix 1-7.
(8) Laboratory animals: listed in Appendix 1-8.
(9) Rabbits for non-laboratory purpose: listed in Appendix 1-9.
(10) Marsupials: listed in Appendix 1-10.
(11) Hedgehog: listed in Appendix 1-11.
(12) Meerkat: listed in Appendix 1-12.
(13) Poultry and birds, poultry and birds from the United States: listed in Appendix 1-13, 1-16.
(14) Day-old poultry and birds and hatching eggs, day-old birds and hatching eggs from the United States, fertilized chicken eggs for research purposes or vaccine production, fertilized chicken eggs for research purposes or vaccine production from the United States: listed in Appendix 1-14, 1-17, 1-21, 1-23.
(15) Bees: listed in Appendix 1-15.
(16) Giant panda: listed in Appendix 1-18.
(17) Tortoises: listed in Appendix 1-20.
(18) Camelidae Animals from Australia: listed in Appendix 1-22.
Article 4
To import dog or cat, it is required to apply for an import permit from the animal quarantine authority prior to import and shall be in compliance with the relevant quarantine regulations.
Article 5
To import the following animals shall be in compliance with the quarantine requirements for the animal species listed in the corresponding appendixes:
(1) Live fish and their sperms and eggs: listed in Appendix 2-1.
(2) Live crustaceans for aquaculture: listed in Appendix 2-2.
(3) Live eel and abalone for human consumption from Australia: Listed in Appendix 2-3.
Article 6
The following animal products are prohibited from importation. However, animal products that comply with the third paragraph are not prohibited from importation:
(1) Products with disease-transmission potential derived from animals susceptible to foot and mouth disease, rinderpest, contagious bovine pleuropneumonia or African swine fever, from countries (zones) recognized as infected with the aforementioned diseases.
(2) Products with disease-transmission potential derived from perissodactyl animals from countries (zones) recognized as infected with glanders.
(3) Products with disease-transmission potential derived from poultry/avian from countries (zones) recognized as infected with highly pathogenic avian influenza or Newcastle disease.
(4) Products with potential to transmit BSE from countries (zones) with reported case(s) of BSE.
For animal products derived from animals susceptible to diseases named in subparagraphs (1) to (3) under the first paragraph which originate from an uninfected country (zone) of such diseases which are transshipped through a seaport or an airport of a country (zone) recognized as infected with corresponding diseases and are not in compliance with the Rules of Import Quarantine Operation for Animal Products Transported by Closed Container, they are deemed as originating from an infected country (zone).
The following animal products may be imported and are not restricted by the first paragraph of this Article if any of the following conditions are met:
(1)Products for research purposes which have been granted by the CCA.
(2)Products evaluated as having no risk of animal disease transmission and subjected to appropriate risk mitigate measures which allow them to obtain prior permission granted by the CCA.
(3)Products which are manufactured by a high-temperature sterilization canning procedure, excluding the products intended for feed use containing ruminant-derived ingredients from countries (zones) with reported case(s) of BSE.
Article 7
To import the following animal semen, embryo, serum and biological materials, it is required to apply from the animal quarantine authority for issuance of quarantine requirements and shall be in compliance with the quarantine requirements listed in the corresponding appendixes:
(1) Bovine semen: listed in Appendix 3-1.
(2) Bovine embryos: listed in Appendix 3-2.
(3) Porcine semen: listed in Appendix 3-3.
(4) Porcine embryos: listed in Appendix 3-4.
(5) Caprine and ovine semen: listed in Appendix 3-5.
(6) Equine semen: listed in Appendix 3-6.
(7) Bovine serum: listed in Appendix 3-7.
(8) Bovine serum from the U.S.: listed in Appendix 3-8.
(9) Canine semen: listed in Appendix 3-9.
(10)Frozen deer semen: listed in Appendix 3-10.
(11)Fetal bovine serum from Canada: listed in Appendix 3-11.
(12)Caprine and ovine embryo from the U.S.: listed in Appendix 3-12.
(13)Biological Materials: listed in Appendix 3-13.
Article 8
To import the following animal products, quarantine requirements listed in the corresponding appendixes shall be complied with:
(1) Game meat and meat products: listed in Appendix 4-1.
(2) Quarantine Requirements for the Importation of Poultry Meat: listed in Appendix 4-2.
(3) Meat derived from artiodactyl animals: listed in Appendix 4-3.
(4) Chilled or frozen beef intended for human consumption from Paraguay: listed in Appendix 4-4.
(5) Chilled or frozen un-eviscerated fish products: listed in Appendix 4-5.
(6) Dog and cat food: listed in Appendix 4-6.
(7) Dry animal products: listed in Appendix 4-7.
(8) Processed products containing meat: listed in Appendix 4-8.
(9) Animal feed preparations: listed in Appendix 4-9.
(10)Animal vaccines: listed in Appendix 4-10.
Article 9
For first-time application for importation of animals or animal products, it is required to conduct risk assessment by the animal quarantine authority. After a risk assessment is completed and concluded that there is no risk for disease transmission or the risk for disease transmission can be controlled, and the relevant quarantine requirement has been adopted, the importation will then be allowed.
Article 10
For importation of animals or animal products which is subject to animal quarantine, it is required to apply for inspection from the animal quarantine authorities prior to import. A veterinary certificate (original) in English, Chinese or in both languages issued by the veterinary authority of the exporting country and a bill of lading (copy) should be provided with the application.
