聯大第2758號決議我方駁斥論述

  • 中華民國台灣是主權獨立國家,與中華人民共和國互不隸屬。我國歷經民主化過程,已經是國際公認的成熟民主國家,只有台灣的民選政府,才有權在包括聯合國體系在內的國際場域代表台灣2,350萬人民。
  • 1971年聯合國大會通過之第2758號決議,僅處理中國在聯合國之代表權,在法理上並未授權中華人民共和國在聯合國體系代表台灣,亦未述及台灣是中華人民共和國之一部分,故該決議並未解決台灣人民參與聯合國之問題。中國政府片面主張其所謂之「一中原則」,實則係法理併吞台灣之陽謀。
  • 聯合國長期屈從中國政治壓力,不當援引並錯誤詮釋聯大第2758號決議,將台灣視為中國之一部分,峻拒我國人民進入聯合國場域參訪、參加會議活動,並剝奪我媒體採訪權,全面阻礙台灣2,350萬人民參與聯合國體系之機會,已違反聯合國憲章揭櫫之普遍性原則,實於法不符、於理不容、於情不合。
  • 中國對台灣日益升高的文攻武嚇,不僅是台海兩岸關係緊張對立的元凶,更引起各國對區域和平穩定的嚴重關切。台灣承諾維持台海穩定現狀,也願透過平等對話解決兩岸歧見,但面對中國的不斷惡意打壓,我們也絕不會屈服。
  • 聯合國一再強調,後疫情時代需要全球所有利益攸關者共同合作面對挑戰,而台灣有能力也有意願為全球疫後復甦及落實永續發展克盡己力。我們感謝友邦及友好國家對台灣推動參與聯合國體系之支持與協助,也呼籲聯合國正視台灣人民參與聯合國體系之殷切期盼,接納台灣有意義參與聯合國及其專門機構,切勿一再屈從中方政治壓力,將台灣排拒在外。

Taiwan’s rebuttal to UNGA Resolution 2758

  1. The Republic of China (Taiwan) is a sovereign, independent country. The R.O.C. (Taiwan) and the People’s Republic of China are not subordinate to each other. Taiwan has undergone a process of democratization and is an internationally recognized, mature democracy. Only the popularly elected government of Taiwan has the right to represent the 23.5 million Taiwanese people in the international arena, including the United Nations system.
  2. UN General Assembly Resolution 2758 (XXVI), adopted in 1971, only addresses the representation of China in the UN. It does not provide legal authorization for the PRC to represent Taiwan in the UN system, nor does it state that Taiwan is a part of the PRC. This resolution, therefore, does not resolve the issue of the Taiwanese people’s participation in the UN. In reality, the “one China principle” unilaterally advocated by the Chinese government represents a blatant attempt to annex Taiwan under the pretext of law.
  3. The UN has long yielded to political pressure from China, regarding Taiwan as a part of China by wrongfully citing and erroneously interpreting Resolution 2758. It has taken severe measures to deny the Taiwanese people access to UN premises for tours and participation in meetings and activities, deprive Taiwanese journalists of newsgathering rights, and cut off all opportunities for the 23.5 million Taiwanese people to participate in the UN system. This illegitimate, unreasonable, and callous approach clearly violates the founding principle of universality espoused in the UN Charter.
  4. China’s relentless intensification of its rhetorical assault and military intimidation against Taiwan has not only escalated tensions in cross-strait relations but also elicited serious global concern over regional peace and stability. Taiwan is committed to maintaining the status quo of stability across the Taiwan Strait and willing to resolve cross-strait differences through parity-based dialogue. However, it will absolutely not bow to China’s continuous attempts at malicious suppression.
  5. The UN has repeatedly stressed that all stakeholders around the world need to work together to tackle challenges in the postpandemic era. Taiwan is willing and able to do its utmost to support global postpandemic recovery efforts and realize sustainable development. It is grateful to diplomatic allies and friendly nations for their support and assistance in its campaign to participate in the UN system. It also urges the UN to duly recognize the earnest aspirations of the Taiwanese people to be a part of the UN system, embrace Taiwan’s meaningful participation in the UN and its specialized agencies, and refrain from repeatedly capitulating to political pressure from China to exclude Taiwan.
