The delivery of high speed connectivity to businesses and residential consumers and communities is required to address the UK’s economic growth and development agenda. Investment will be required to deploy broadband infrastructure and the topography and/or demographic characteristics of certain geographies, together with the lack of competitive pressure, means that market-driven private investments alone will not achieve the UK Government's objectives relating to the delivery of standard and superfast broadband across the UK as a whole. Broadband Delivery UK (BDUK) has been created within DCMS to be the delivery vehicle for the Government's policies relating to stimulating private sector investment using the available funding. Further details on BDUK and its current objectives and activities can be found at: http://www.culture.gov.uk/what_we_do/telecommunications_and_online/7781.aspx. BDUK is seeking to establish a framework agreement of suitably qualified suppliers capable of delivering local broadband projects as required by local bodies or groups of local bodies in regions throughout the UK. Further details of the "local bodies" who may make call offs under the framework agreement are included in Section VI.3. The framework agreement is expected to be the procurement vehicle for the majority of local broadband projects once they have been allocated BDUK funding. There may be a small number of local broadband projects that do not use the framework agreement and this will be agreed with BDUK. Suppliers appointed to the framework agreement will need to be capable of delivering a range of broadband and related requirements, including (but not limited to):
— The design, build, implementation and operation of wholesale broadband networks. Call offs may be at the equivalent of a sub-county, county, multi-county or regional level and such areas could potentially be up to the order of 500 000 premises. As a minimum a supplier will need to have the capability to deliver at least one local project as defined in the Pre-Qualification Questionnaire,
— Broadband solutions that meet outcomes-based specifications rather than being tied to specific technologies and platforms,
— Open access wholesale services including those that can be made available by retail service providers (e.g. Internet Service Providers) as part of their retail broadband packages for business and residential customers,
— Related services including (but not limited to) marketing services, demand stimulation and ancillary services. It is currently anticipated that the initial term of the framework agreement will be two years with the possibility / option to extend this by up to 2 one year extensions, making a maximum possible term of 4 years. Following completion of each design, build and implementation phase, it is anticipated that call off contracts will run for a minimum operational period of seven years essentially in order to comply with State aid requirements relating to open access. There is the potential for the framework agreement to cover projects with an estimated total value of between 750 000 000 and 2 000 000 000 GBP (see further details on financing and payment arrangements in Section III.1.2). This estimated total value is based on the total level of public subsidy and private sector investment expected to be put towards the funding of projects. The public subsidy will comprise BDUK funding and funding from the local body (which may include funding derived from the European Regional Development Fund). The private sector investment will comprise investment from suppliers appointed to deliver projects via call-off contracts. Further detail is included in the Pre-Qualification Questionnaire which will made available through the Delta eSourcing procurement portal within a week of the date of despatch of this contract notice and which will be available until the date specified in Section IV.3.3. Interested suppliers are invited to attend a briefing session via teleconferencing on 5 July 2011 at 11:00 to assist them in completing the Pre-Qualification Questionnaire (see Section VI.3 for further information about this session).

It is anticipated that local broadband projects called off under the framework will be funded by an appropriate mix of public subsidy and supplier investment (see Section II.1.5 regarding the funding sources and the total estimated value). The level of anticipated public subsidy will involve the granting of State aid to local projects. Further detail on the relevant aspects of the financing and payment approach will be provided in the Invitation to Participate in Dialogue documents to be issued to pre-qualified bidders.

Requests to participate may be submitted by a single candidate or a group (consortium). II.1.4: It is anticipated that 6 – 12 suppliers will be appointed to the framework. This will be subject to:
(i) in the first instance, suppliers meeting the relevant selection criteria and BDUK's discretion to limit the number of suppliers to be invited to participate in dialogue as set out in Section IV.1.2; and
(ii) subsequently, suppliers meeting the relevant award criteria and the bids received.
In line with the Coalition Government's policy on supplier diversity, BDUK is designing the framework agreement to maximise opportunities for SMEs to form part of framework suppliers' supply chains for projects where appropriate. Some of the steps BDUK and local bodies will take to achieve this can be found in the Event Slides from the Industry Day held on 8.6.2011. The Event Slides and other information on the Broadband Delivery Framework (including responses to frequently asked questions raised by suppliers) can be found at: http://www.culture.gov.uk/what_we_do/telecommunications_and_online/7781.aspx.
Sections II.1.4, II.1.5 and II.2.1: The value range quoted is an estimate of the anticipated level of expenditure by suppliers (using public subsidy and private sector investment) in respect of local projects called off under the framework agreement. As noted in Section II.1.5 above: the public subsidy will comprise BDUK funding and funding from the local body (which may include funding derived from the European Regional Development Fund); and the private sector investment will comprise investment from suppliers appointed to deliver local projects via contracts called off under the framework agreement.
Section IV.3.3: The Pre-Qualification Questionnaire will be available through the Delta eSourcing procurement portal within a week of the date of despatch of this contract notice and will remain available until the date and time specified in Section IV.3.3.
Section IV.3.4: Requests to participate must be made by completion and return of the Pre-Qualification Questionnaire by the date and time specified in Section IV.3.4 and in accordance with the instructions set out in the Pre-Qualification Questionnaire. Completed Pre-Qualification Questionnaires submitted after the deadline may not be considered.
Pre-Qualification Questionnaire briefing: to assist suppliers in the completion of the Pre-Qualification Questionnaire, a briefing session will be held via teleconferencing on 5.7.2011 at 11:00. Interested suppliers will be provided with further information about this briefing session through the Delta eSourcing procurement portal, which they must register to use. Instructions on how to register to use this portal are set out below.
DCMS and the contracting authorities shall not be responsible for any costs, charges or expenses incurred by candidates or tenderers and accept no liability for any costs, charges or expenses, irrespective of the outcome of the competition, or if the competition is cancelled or postponed.

Precise information on deadline(s) for lodging appeals: In accordance with Regulation 32 of the Public Contracts Regulations 2006 (as amended) the contracting authorities will incorporate a minimum 10 calendar day standstill period at the point information on the framework agreement award decision is communicated to tenderers. Part 9 of the Public Contracts Regulations 2006 (as amended) provides for economic operators who have been harmed or are at risk of harm by breach of the Regulations to take legal action. Any such action must be brought within the applicable limitation period.
