爭議流程處理參考 1. 聯邦貿易委員會(Federal Trade Commission, FTC)為美政府主管消費者保護之聯邦政府機關,設有消費者保護局(Bureau of Consumer Protection, BCP),主要任務為保護消費者,避免遭受不公平、瑕疵或詐騙交易行為之侵害,尤其在打擊對消費者詐騙方面,例如網路詐騙、投資詐騙、電話行銷詐騙、汽車貸款及維修服務詐騙,以及信用貸款詐騙等,一直為該局之主要任務。FTC接受消費者之申訴,並將相關申訴資訊彙整成為資料庫,提供美聯邦、州及地方政府以及其他國家消保及執法機關等進行刑事犯罪或民事案件調查,以及作為研析消費詐騙類型及趨勢等之用,惟並不對消費者所申訴之消費爭議個案內容介入處理。 2. 美各州多由州檢察署(Office of Attorney General)負責處理消費者之申訴,亦有設置消費者保護局負責處理者,地方層級(郡或市)則多設有消費者保護事務部門。以紐約州政府為例,州檢察署下之消費者保護局(Bureau of Consumer Frauds and Protection)提供民眾有關消費者交易及爭議處理之諮詢服務,並由消費者保護專員提供有關爭議調解之服務,倘若調解不成,並提供買賣雙方參與仲裁之機會。 3. 在消費者保護團體方面,美國非營利民間機構「Better Business Bureau」(BBB)成立之目的主要在增進消費者對企業經營者之信賴,提供消費者購買商品前之相關資訊,並協助解決消費糾紛。BBB及其他許多消費者保護團體,並提供申訴管道,以及諮商、調解及仲裁等服務(https://www.bbb.org/)。 4. 爭議流程處理參考: 發生消費爭議>向企業進行客訴>向地方(市或郡等)及州政府之消保單位或消費者保護團體申訴,申請調解(調解不成,申請仲裁)>提出消費訴訟。
